Terms and Conditions
Section 1. Booking
By placing a booking at Forget Me Knot Bed and Breakfast with us (the property owner/his/her representative) you (the lead guest) and your booking party (guests) agree to the following terms and conditions as set-out. During your stay you agree to abide by the subsequent conditions as set-out. If you have any questions about booking with us, please contact us before making a booking.
To place a booking with us the lead guest must be at least 18 years of age. Where the person making the booking is different to the lead guest taking up the occupation, the person making the booking may be held responsible for cancellation, non-arrival and damages as set out within. The minimum age of guests is 18 years of age. Only the lead guest and the named booking party are allowed to use the property and its facilities, any third-party visitors are only allowed access at our express permission
When you make your booking and we have received the required deposit a legally binding contract exists between us that is non-cancellable and non-refundable, except in accordance with the cancellation terms and time periods as set out in section 2. You may still remain liable to pay in full or in part for the booking, even if you are unable to take your holiday. Even where you have not paid in full at the time of cancellation, you will remain liable for the full cost outstanding as defined under the cancellation terms in section 2. If for some reason you do need to cancel, it is important that you tell us at the first opportunity so that we may attempt to re-let your room and minimise your loss. You should take out cancellation insurance to protect you against possible loss.
Some rate plans/special offers require payment in full and are non-cancellable, non-refundable, non-changeable and non-transferable. This will be identified in the rate description. For these rate plans/offers once you make a reservation your credit card will be charged for the full amount. Credit will not be given for any unused reservation and the amount paid by you for such reservation cannot be used toward any other/future reservation. All special offers offered by us are subject to these terms and conditions together with any terms and conditions specific to that Offer. In the event of a conflict between the Offer Terms and these terms the Offer Terms shall take precedence
Under the Immigration (Hotel Records) Order 1972, all hotels, guest houses, bed & breakfasts, etc. must keep a record of the full name and nationality of their guests over 16 years of age. Non-UK or commonwealth citizens must also record the number and place of issue of their passport, or other document which shows their identity and nationality and their next destination. To that end, a Guest Registration form must be completed upon arrival. These details may also be given at time of booking if you wish.
If you become ill whilst staying with us and are unable to travel, then you will be liable for any costs associated with your extended stay. This will include the cost of additional nights and any meals provided. Exceptionally it may also result in a charge for any other cost associated with your extended stay e.g. any cost we would incur for relocating/refunding guests due to stay in the property you are occupying.
The maximum period of a booking is 14 days. This includes any stay extended due to ill health as described in 1.6 above. Guests have a right to occupy the accommodation for holiday use only within the meaning of the housing act 1968 and this booking does not confer a shorthold tenancy or give rise to a relationship of landlord and tenant.
We accept most major credit/debit cards and card details will only be held for so long as is required to process payments due under this contract. We do not accept cash payments for bookings and do not have any cash handling facilities.
Smoking of any tobacco products including, but not limited to, cigarettes, pipes, e-cigarettes, e-liquids, cigars or vapes is only allowed in the accommodation grounds and is in accordance with the health act 2006 strictly forbidden inside the accommodation. If you do smoke or vape inside our rooms and/or have been found to have interfered in any way with any of our fire detection equipment you will be required to pay damages to us. The amount of such damages shall be determined by us but shall not be less than £100. The fire detection system installed in the accommodation is a 24 hour remote monitored system and its activation will result in a response from the fire brigade. Any charges from the fire brigade/monitoring station as a result of smoking or tampering with the fire detection system will be directly recharged to the lead guest.
No pets are allowed anywhere inside the property and/or the grounds. This includes keeping animals in vehicles overnight.
If you or any guest has any individual needs, such as reduced mobility, please advise us before making your Booking and we will be able to check if we are able to meet your specific needs. Wherever possible we will always try to accommodate guests where reasonable to do so.
We request that you conduct yourself and ensure that all other guests in your booking conduct themselves appropriately at all times and comply with all notices and requests regarding health and safety, respecting the premises, our neighbours and ourselves. Violent or threatening behaviour is not accepted in any form. You are liable for any act or omission of guests staying in the accommodation including where damage is caused. You are responsible for ensuring that all of your guests are aware of and comply with the terms of this booking.
We reserve the right to charge the lead guest for any damages or loss caused through the course of a booking by any member of the booking party. This includes but is not limited to breakages, spillages, stains, damage to furniture, fixtures and fittings or plumbing. We appreciate that accidents can happen and take a sensible approach to damage and breakages. We would not charge for a broken mug or glass however please do inform us of any breakages or damage so that we can put it right as soon as possible. This helps us to minimise damage and associated costs and/or impact on the next guests booking. Bdsm furniture, equipment and toys are for decoration and set dressing purposes only. Any use of these items is strictly at your own risk and we will not be liable for any injuries caused.
Lost Property if found will be held for 28 days. We will make our best efforts to recover the property to the guest concerned if known. We accept no responsibility in replacing lost or damaged items. We may be able to post items via a tracked delivery service at the guests cost if asked or collection can be arranged. After 28 days the property will be disposed of.
Lost keys will incur a charge. In order to preserve the security of future guests in the event of a lost key the lock cylinder will be replaced. A minimum charge of £100 to cover cylinder lock and key replacement by a locksmith will be payable. Should the replacement charges be more than the minimum charge then the lead guest will be charged at cost.
Wi-Fi The Internet access provided is intended for general use such as access to the world wide web, email, messaging, social media, light video/music/media streaming. It is not intended or ideally suited for heavy media streaming, online gaming, extensive downloads/uploads. Guests must not use the Wi-Fi to download or upload any unlawful, harmful or obscene materials, or to place an unreasonable burden on our network.
We only supply our accommodation for domestic and private use. If you use our accommodation for any commercial, business or re-sale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity, or loss or reputation and/or goodwill, or similar.
We will have no liability to you or to any third party in respect of any property, equipment, food or drink that you bring onto our premises as part of your stay.
We will not be liable/responsible for any loss as a result of failure of public services including gas, water, electricity phone etc. or any disturbance that is beyond our control.
Free Parking is available for two vehicles in a designated area at the property. All vehicles are left at the owners risk and we do not accept responsibility for loss or damage. Guests vehicles may only be parked during the period of a booking and may not stay beyond the associated check out time. Vehicles parked outside of a booking will be charged at £90 per day or part thereof.
Check-in is between 3:00pm and 9:00pm. Check-out is by 10:00am. Where possible we will accommodate early/late checking times and do not charge for this facility. Any requests for early or late checking times will be confirmed via email a minimum of 48 hours prior to the booking start date.
Single night stays require payment in full at the time of booking. Stays of two or more nights will require a 50% deposit payment at the time of booking with the outstanding balance being due no later than 48 hours prior to the booking start date. Stays that begin within two days of the booking date will require full payment at time of booking. Special offers and certain times of the year may have different booking requirements and these will be identified in the booking quote and/or offer details.
Section 2. Cancellation
To cancel a booking please let us know by emailing us with your cancellation details to firstname.lastname@example.org. We will confirm the cancellation of your booking in writing to you. Your booking will not be considered cancelled until you have received written confirmation from us.
Where a refund is due to you in accordance with this contract, we will refund you by the method you used for payment. We will make any refunds due to you as soon as possible.
In the event that you fail to end the contract booking in accordance with these terms and do not arrive to take you reservation the full amount of your booking will be due and no refunds will be given.
If you wish to make a change to your booking please contact us. We will let you know if the change is possible and about any changes to the price of your booking or anything else which would be necessary as a result of your requested change.
The right to cancel under the Consumer Contracts Regulations 2013, does not apply to your contract for room hire governed by these terms as this contract is a contract for room hire whether for accommodation purposes or as a function or meeting room to be provided on a specific date. You therefore do not have a right to cancel under the Consumer Contract Regulations 2013.
We may end this contract if you break it with immediate effect and if appropriate eject you or a member of your booking party from the premisses if you do not make any payment when it is due. Wilfully or negligently interrupt our business or cause disturbance to our neighbours or are otherwise in breach or provision of these terms.
In the unlikely event that we have to cancel the booking due to circumstances beyond our control we will provide a full refund of monies paid. No further financial claims or liability will extend beyond this refund.
Bookings cancelled more than 14 days prior to the booking start date will receive a full refund. Bookings cancelled less than 14 days days prior to booking start date the deposit will be non refundable but no further charges will be liable. For single night stays the deposit will be an amount equal to 50% of the total cost of the stay. Special offers/deals my have their own terms and these will take precedence as set out in 1.4 above.
Any outstanding balance due on a booking must be paid in full a minimum of 48 hours prior to your booking start date. Failure to pay the booking fee in full a minimum of two days prior to the booking start date will result in the booking being cancelled and the refund conditions set out in 2.8 will apply and any deposit paid will be forfeit. Special offers and certain times of the year may have different cancellation requirements and these will be identified in the booking quote and/or offer details.
Section 3. Other Important Terms
For the purposes of these terms and conditions writing includes email.
If we have to cancel your booking due to a covid 19 lockdown we will refund any payments made in full.
If you are already staying with us and we had to ask you to leave due to a national/local covid 19 lockdown or self-isolation due to staff testing positive we would refund you the nights you could not stay in full pro rata.
You need our consent to transfer your rights to someone else. You may only transfer your rights or your obligations under these terms to another person if we agree to this in writing (which in this context shall not include email).
If a court finds part of this contract illegal, the rest will continue in force. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
Rates quoted in respect of your booking are applicable for your specific booking only and are personal to you. Your booking cannot be assigned to a third party.
You will have no right to have a booking cancelled, amended, refunded or transferred where you have booked a room with us under a special offer unless specifically detailed in the offer terms.
Your privacy is important to us and we will never sell or distribute your information to third parties other than as required by law or for processing of payments.
Data protection laws categorise certain personal information such as information about your health, religion and ethnicity as sensitive and therefore require greater protection. We do not usually collect sensitive data about you unless there is a valid reason for doing so and data protection laws allow us.
We may collect your name and contact details including address, email, telephone numbers, your date of birth.
We may also collect bank or credit details. This information will only be held for as long as is required to process any payments/refunds that may be due. Where payments are made through our third-party payment processor they will use secure online capture and processing of credit/debit transactions in accordance with current financial regulations.
We may use your information to process bookings and orders that you have submitted. Carry out our obligations arising from any service contracts entered into by you and to notify you of changes to our services.
We keep your information for no longer than is necessary for the purposes it was collected for. The length of time we retain your personal information for is determined by operational and legal considerations. For example, we are legally required to hold some types of information to fulfil our statutory and regulatory obligations for health/safety and tax/accounting purposes and Hotel Records Order act.
We will not sell your information to third parties.
We will not share your information with third parties for marketing purposes.
Non-sensitive details (your email address etc.) are transmitted normally over the Internet, and this can never be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, we cannot guarantee the security of any information you transmit to us, and you do so at your own risk. Once we receive your information, we make our best effort to ensure its security on our systems. Where we have given (or where you have chosen) a password which enables you to access certain parts of our website, you are responsible for keeping this password confidential.
We may be required to make changes to these terms and/or your booking to reflect changes in relevant laws and legislation or regulatory requirements. To implement minor technical adjustments and improvements or to modify your booking should any details be incorrect. We will let you know if the modification is possible and about any changes to the price of your booking or anything else which would be necessary as a result of the modification required.
We endeavour to ensure that our website, third party websites, booking sites and other materials relating to our services are accurate, the content and information are provided for general information only and it is not intended to amount to advice which you should rely upon. We make no representations, warranties or guarantees, whether express or implied, that such content is accurate, complete or up to date. Where a Booking is made on a Third-Party Booking Site, or where our website contains links to other sites and resources provided by third parties, we have no control over the contents of those sites or resources and any links are provided for information only.
